The Australian Consumers' Association (ACA) has submitted comments to the Federal Senate Legal and Constitutional References Committee regarding the 1988 Privacy Act, arguing that the law is inadequate to face the challenges presented by e-mail. Specifically, e-mail fails to seek consent from recipients, provides no unsubscribe mechanism, and does not provide identification, making e-mail a haven for spam. Such a free-for-all environment could drive consumers away from e-mail and regulatory and cost constraint are necessary to make e-mail manageable, preferably with an 'opt-in' approach. Lockstep Consulting has called for further research into the privacy threats posed by phishing and spam.
