Orson Swindle, Republican commissioner for the US Federal Trade Commission (FTC), considers corporations "irresponsible" for failing to protect consumer data. Swindle believes the weak privacy protections are driven in part by lawyers who advise corporations not to promise too much in their privacy policies in order to avoid lawsuits. Entrust chief executive Bill Connor calls for a national law requiring organizations to notify consumers when they suffer a breach that might have compromised their privacy, but want the law to shield organizations that encrypt data from liability suits; encryption eliminates 80% of the vulnerabilities data would have if left unencrypted. Senator Dianne Feinstein is proposing a national disclosure law that would include liability for both encrypted and unencrypted data.
