Ex-AOL employee Jason Smathers, 24, has pleaded guilty to stealing 92 million customer names and e-mail addresses from AOL’s database. Mr. Smathers sold the addresses for $28,000 to Sean Dunaway, who used them to promote a gambling website before selling them to other spammers. Mr. Smathers tried to make a guilty plea in December 2004, but it was rejected, as the judge was not certain a crime had been committed. Mr. Smathers finally pleaded guilty to conspiracy and interstate transport of stolen property, and faces up to two years in prison and between $200,000 and $400,000 in restitution when he is sentenced May 20, 2005.
